LUSAKA MAGISTRATE ACQUITS FARMER DOUGLAS WATT OF SODOM
CHISAMBA farmer Douglas Watt has been acquitted of sodomy by the Lusaka Magistrates’ Court.
This is in a matter where Watt was facing charges of unnatural offences for allegedly having carnal knowledge of a 17 -year-old boy and posessing pornographic material.
Allegations were that Watt between May and July 17, 2019 had carnal knowledge of the 17-year-old against the order of nature.
It was on the same dates alleged that the farmer had obscene pictures and videos on a cellphone, materials tending to corrupt morals.
In his ruling on no case to answer, Lusaka chief resident magistrate Lameck Mwale said the prosecution’s evidence adduced by state witnesses was so manifestly unreliable as it was discredited in cross-examination that not reasonable tribunal properly directing itself would safely convict or admit it.
Magistrate Mwale said the juvenile whom the accused was jointly charged with was not brought to court to testify in the matter to support the allegations.
He said the juvenile’s medical report does not show that Watt was having anal sex with him upon being examined on his penis and anal regions.
Magistrate Mwale said none of the witnesses indicated that they saw the accused having anal sex with the 17-year-old boy.
He said there was nothing obscene about pictures and videos of women in bikinis at the beach.
“In the premises, I would find it difficult to convict the accused in an event that he chose to remain silent. I find that the prosecution has failed to establish a prima facie case against the accused in respect of both counts and I find him with no case to answer in respect thereof and in line with section 206 of the CPC cap 88, I dismiss the charges against him and accordingly acquit and set him free forthwith,” said magistrate Mwale.
